Minutes of Conservation Commission Public Meeting

4:00 - Business Meeting & Conservation Agent's Report
Co-Chair Edwin Reynolds opened the meeting at 4:00 pm.

Jurisdictional Opinions:

Zelman, 115 Atlantic Ave, drill a replacement well.  Ginie Page moved to continue the request to June 4 because he has another issue with the Commission; seconded by Cyndi Moe; passed 6-0.

Herbert, 260 Bay Berry Lane, remove several trees hanging over the house and replace some decking.  Cyndi Moe moved to approve the Jurisdictional Opinion; seconded by Dottie Dolan; passed 6-0.

Cyndi Moe stated the TD Bank North exceeded their Jurisdictional Opinion.  

Christine Odiaga, DEP, stated there is a storm management regulations workshop scheduled for June 3, 2008 from 1:00 pm to 3:00 pm in Provincetown.  She gave an overview of the new regulations.  She advised the Commission that there will be electronic forms available in September to reduce paper.  She provided a list of referenced links.  A workshop is scheduled for June 5, 2008 at 10:30 am for Flood Resistant Construction in Coastal Dunes and Flood Hazard Zones in the Harwich Town Hall.  CZM will be hosting a workshop May 28, 2008 from 9 to noon at Barnstable Town Hall on “Storm Smart Coasts”.  She listed several workshops to be held in Boston this fall.  She stated she will provide a list of workshops coming up for the fall that will be local to the Cape.  There was discussion regarding “best management plan” and Petty requested she provide more in depth information.  She stated she could not promote any particular products but would be willing to talk to people on an individual basis.  
 
   Chapter 91;  The Bezio’s of 135 Marven Way want to install fencing to the mean low water line on their property to prevent people from walking on the established path.    

There was discussion regarding tree cutting for solar panels and there is information available from the State regarding the percentage of trees that can be taken from property.

Petty stated the stream located at Chequessett Neck and Powers Landing has shifted and has moved over to the town marsh and and is now affecting people’s property.  Owners would like to do a nourishment plan and move the stream.  

The May 7 meeting minutes will be reviewed at the June 4 meeting.    
    
Petty reported there are two new billboards located at the Library and at the DPW building with conservation information available to the public.  He suggested a billboard be placed at Town Hall.

Public Hearings 5:00 pm:  Town Hall Meeting Room (basement)

5:00 pm Shapiro, 348 King Phillips Rd., Map 35, Parcel 183, Certificate of Compliance (Cont’d 5/2/08).  Don Monroe from Coastal Engineering represented Shapiro and stated they met with Paul Banner, President of the Association.  He stated they will perform a site visit every 5 years to calculate the nourishment requirements.  Dolan questioned if the Army Corps of Engineers would reconsider the removal of the groin. Ginie Page moved to issue a Certificate of Compliance; seconded by Cyndi Moe; passed 6-0.  

5:08 pm  Glaze, 625 Old Wharf Rd., Map 35, Parcel 14, NOI, Septic Upgrade (Cont’d 5/2/08).  The applicant requested a continuation to June 4.  Ginie Page moved to continue to June 4, 2008; seconded by Dottie Dolan; passed 6-0.  Petty noted it was approved by the Board of Health as written.  Petty stated he will bring the minutes from that meeting.

5:12 pm  Halloran, 1360 Chequessett Neck Rd., Map 18, Parcel 5, NOI, Relocate existing dwelling outside buffer zone and abandon existing well (Cont’d 5/2/08).   The applicant requested a continuation to June 4, 2008.  Cyndi Moe recommended a post or sign be placed for safety reasons at the road.  Cyndi Moe moved to continue to June 4, 2008; seconded by Ginie Page; passed 6-0.

5:20 pm  Parlante (Bookstore Restaurant), 50 Kendrick Ave., Map 20, Parcel 3, NOI, Septic Upgrade Cont’d 5/2/08).  Emily Beebe represented the applicant and gave an overview of the storm water management plan which was revised on 5/21/08.  She went into detail regarding the grading and swale locations, driveway makeup, and type of seed to be planting on the slope.  Cyndi Moe moved to approve the NOI, dated 5/21/08, seconded by John DiBlasio with conditions; passed 6-0.  Supervisor:  Cyndi Moe        

5:45 pm  Zelman, 115 Atlantic Ave., Map 36, Parcel 33, RDA, Install water line (Cont’d from 05/02/08)
The applicant requested a continuation to 6/04/08.  Cyndi Moe moved to continue to 6/04/08; seconded by John DiBlasio; passed 6-0.

5:46 pm  Town of Wellfleet, various streets, NOI, Installation of new 12” water main.  The applicant requested a continuation to June 4, 2008.  Dottie Dolan moved to continue to 6/04/08; seconded by Cyndi Moe; passed 6-0.

John DiBlasio moved to adjourn at 5:48 pm; seconded Ginie Page; passed 6-0.
